Ownership and rights

Reproduction of all or part of this site without written permission is prohibited. Copyright of all content not otherwise acknowledged rests with Somerset Media.

Copyright
By sending video, photographs or other media to us, you are agreeing that either you hold the copyright to the media, or have the express permission of the copyright holder to use the media. Somerset Media will not be held responsible for any breach of copyright. Please note that, because of this, we cannot copy commercially recorded material.

Privacy and confidentiality
All information given to us by you will be regarded as strictly confidential. Your details will be used only for purposes directly related to fulfilment of your order, and will never be passed on or sold to any third party. We will treat all your personal information that we collect in connection with your order in accordance with the terms of the Data Protection Act 1998.

Credit Card Security
Any credit card numbers entered online are handled by our payment processor, Paypal. Your credit card number will not be passed to our site and will not held in clear text on any website.

Accuracy
Great care has been taken to ensure the accuracy of all information presented on this site. However, Somerset Media is not responsible for consequential loss resulting from any errors.

Complaints
If you are not happy with the service we provide, please contact us in the first instance to discuss the problem. If we cannot come to a mutually acceptable solution, any money paid so far will be refunded.

Proofing your work
You are responsible for checking your work upon receipt. Any discrepancies must be notified within 14 days. There is 30 days grace on new websites where any design changes or updates will be done free of charge, after which, work will be charged at our normal hourly rate. If you have supplied text for your website for copy and pasting, you are responsible for it's accuracy. Any mistakes on your part are chargeble.

Refunds
If you cancel your Agreement and are entitled to a refund, we will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 30 days of the day we received your notice of cancellation.

Loss or damage
Somerset Media will not be liable for items lost or damaged in the postal system or sent via any other means. Please send any originals to us by recorded or special delivery.

Prices and Payment
Prices for services are quoted on the site. The final total will be agreed with you and notified before the work starts. Payment must be made before your order is released to you. We may withhold release if the price is not received from you in full, in cleared funds. The prices on the site include value added taxes where applicable. Prices for services are liable to change at any time, but changes will not affect agreements which have come into force. We will require a minimum of 50% deposit on work over the value of £100. If any work has been carried out and you cancel the order, this deposit is non-refundable.

Jurisdiction
Somerset Media is situated in the United Kingdom, and contracts are entered into in accordance with UK law. Any claims arising will be dealt with under the United Kingdom legal system.
If any provision of this agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this agreement shall remain in full force and effect, and such invalid or unenforceable provisions or portion thereof shall be deemed omitted.

Pay Monthly Terms & Conditions
The website design produced for the client on a 'pay monthly' basis is for the leasing of the design and remains the property of Somerset Media. If a customer decides to cancel the monthly subscription then the lease of the design shall be cancelled and the customer will no longer be permitted to use the design or its coding.

Pay monthly web design packages have a minimum term of 12 months.After 12 months the customer can choose to renew the contract on a month to month basis and the website will remain live as long as payments are received on time (usually the 1st of the month) Or if you have paid online, each 30 days after the date that you signed up.

Should the client make a late payment, Somerset Media reserves the right to suspend the website after 7 days until payment is received. If no payment is received or we do not hear from you, the site will be removed from the server after 28 days. You will be liable for the rest of the 12 payments which will be invoiced to you.

Somerset Media will review your account periodically to assess your level of service to make sure you are getting the best value for money. The website is leased on a monthly basis and as long as the site is live for any given period, the fees are not refundable.

If Somerset Media registers a domain name on your behalf, it will be registered to our current address. The client remains the legal owner of the domain and if they request that details be changed or the domain transferred elsewhere, Somerset Media will do this within a reasonable time. There is an administration fee of £25 for this.

 Where a client orders a pre-packaged website, only the details as set out in the package will be available. Any extras such as logo design or stock photo acquisition etc will be charged extra.

Should the client wish to buy the leased site after the minimum period of twelve months, we will value the site at our normal cash rates taking into consideration any extra pages and updates we have done on your behalf during the leased period and give a reduced quote taking into account any payments you have made while leased to you. Discount is at our discretion. The site is not transfeable while the lease is in progress.

The website package is set at the time of ordering depending on your requirements. This can be upgraded at any time to take into account your expanding business.

The monthly leasing package includes the cost of hosting and the domain name. If the domain name has been purchased elsewhere by the client, they are responsible for renewal.

The client is responsible for any material they supply to Somerset Media for use on their website and that they have the legal right to use it. This includes any text copy and/or copyright.

Somerset Media uses the best business hosting available and make every effort to ensure that our servers are reliable and that the client can expect that there will be a minimum amount of down time. But we take no responsibility for any suggested or incurred loss of sales as a result due to unforeseen technical failure.
